Mini session Contract

ENTIRE AGREEMENT: This agreement is between Lauren Haley Photography (herein after “LHP”) and THE CLIENT (that’s you!). It supersedes all prior and simultaneous agreements between the parties. The only way to change or add to this agreement is to do so in writing, and providing the document is signed by all the relevant parties. THE CLIENT understand that this signed contract along with the session fee paid in full constitutes an order for photography.

LEVEL OF SERVICE: The parties agree that LHP will furnish mini session photography services as itemized below:

- One 30 minute session

- 100+ High-resolution images delivered through an online gallery

- Outfit planning + session guide

DIGITAL NEGATIVES, PRINTS and COPYRIGHTS: The photographs and digital negatives by LHP are protected by Copyright Law (all rights reserved) and may not be reproduced in any manner without LHP’s explicit written permission. As the author of all images made hereunder and as provided for by law, LHP shall retain the copyrights in perpetuity, regardless of possession or ownership of negatives, photographs, digital files or any other format of reproductions. Upon delivery of the final images, limited copyright ownership of the resulting images will be transferred to THE CLIENT under the following conditions:

- The digital negatives are the property of THE CLIENT for personal use and personal use reproduction (printing).

- THE CLIENT must obtain written permission from, and compensate LHP prior to an event where THE CLIENT or THE CLIENT’S friends or relatives publish or sell the photographs for profit.

- Images may be posted on personal web sites/blogs/Facebook by THE CLIENT with the above understanding and an acknowledgment or credit to Lauren Haley Photography (@laurenhaley).

- Images may NOT be altered or edited in any way.

Upon delivery of the images to THE CLIENT, THE CLIENT will gain personal, non-commercial rights to the images, at which point the images can be used for personal printing or personal digital sharing. THE CLIENT may not use these images for commercial purposes, including but not limited to monetary or contest purposes. LHP may use the images from THE CLIENT’s session for self-promotion or other commercial purposes on various digital and/or printed platforms, unless is requested that THE CLIENT’s images be kept private by checking the box at the end of this contract.

DIGITAL IMAGES DELIVERY: No longer than 3 weeks after the session date, LHP will provide THE CLIENT with the edited mini session images. LHP will choose the images to be manipulated and edited, and is not responsible for editing all the session images. Final images will be delivered through an online private gallery.

NON-GUARANTEE: Although every possible care will be taken to produce photographs during the mini session, LHP cannot place an unconditional guarantee on the above. LHP will to the best of it's ability make an effort to capture high quality images under a variety of lighting, location, and human variables, and will use all it's tools and abilities to capture high quality images to the satisfaction of the CLIENT. LHP may use different cameras, lenses, poses and may do several shots of the same scene because of any number of variables. LHP is notresponsible for non-photogenic subjects, moving subjects, changing human or environmental conditions that could affect the quality or composition of the images captured. LHP is not responsible for catastrophic equipment failure due to unforeseen incidents or acts of God. Equipment redundancy is standard operating procedure and will be put to use in the event of equipment failure. Although care will be taken with the digital images, LHP limits any liability for loss, damage, or failure to deliver photographs for reasons beyond her control, including but not limited to illness or accident.

PROFESSIONAL IMAGE MANIPULATION: LHP will perform limited professional image manipulation (if technically possible) on any of the digital images. This includes opening of individual’s eyes, red eye removal, removal of objects, color correction, special effects, portrait glamorization, etc. at LHP’s discretion. After the delivery of the final digital images, it is understood that THE CLIENT will reside with the fact that LHP has performed to it's best ability with regard to image manipulation and editing, and that LHP has no further responsibility towards image manipulation and editing.

ARTIST DISCRETION: THE CLIENT understands that the work of LHP is always evolving and that the final edited images THE CLIENT receives may or may not represent the work LHP previously created weeks, months, or years prior. Each image is taken and edited with the upmost care at the discretion of the artist, LHP.

FINAL PAYMENT: The $100 non-refundable retainer fee was paid when you booked your date and goes towards the mini session. On the day of your mini session, your remaining session balance of $250 will be due.

Final payments are to be paid by cash or through Venmo (@laurenhaleyk).

RESCHEDULING: If you need to reschedule your session due to Covid, the air quality, or weather, I ask to be notified at least 24 hours in advance. I allow rescheduling free from any additional charges. If none of the mini session dates work for you, please reach out and communicate a few dates that will work so we can get you on my calendar.

By executing this Agreement, the parties certify that they have completely read and understand this Agreement, and that it's terms are fully understood and voluntarily accepted.
